These Terms of Service (“Terms”) govern your access to and use of the BITFLUX website (www.bitflux.link), the BITFLUX app (including app.bitflux.link and any BITFLUX mobile apps) and related services (together, the “Services”), provided by BitFlux Limited (“BitFlux”, “we”, “us” or “our”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. About us
BitFlux Limited has its office at Room 602, 6/F, Kai Yue Commercial Building, No. 2C Argyle Street, Mong Kok, Kowloon, Hong Kong.
2. Eligibility
To use the Services, you must:
- be at least 18 years old and have full legal capacity to enter into these Terms;
- not be located in, or be a resident or citizen of, a country or region where the Services are not available or where using them would break the law; and
- not be the subject of sanctions or named on any sanctions list, and not act on behalf of such a person.
We may refuse to provide the Services to anyone at our discretion, including where required by law or our risk policies.
3. The Services
The Services may include a multi-asset wallet, currency swap, the BF Card, fiat withdrawals to bank accounts, multi-chain deposits and withdrawals, and a referral program. Features are released in phases. The features, assets, networks, currencies and limits available to you depend on where you are, your verification tier and what is live in the app at the time. Some Services are provided by, or with the help of, third-party partners such as card issuers, payment providers, banks and custodians, and may be subject to their additional terms.
Nothing on our website or in the app is an offer or solicitation to anyone in any jurisdiction where such an offer or solicitation is not authorised or would be unlawful.
BitFlux is not a bank. Balances held through the Services are not bank deposits and are not protected by the Hong Kong Deposit Protection Scheme or any similar scheme.
4. Your account and verification
- You must give us accurate, complete and current information and keep it up to date.
- We will ask you to verify your identity. Your limits depend on your verification tier (KYC-0, KYC-1 or KYC-2), and we may ask for more information or documents at any time.
- You may hold only one account unless we agree otherwise. Your account is personal to you and cannot be transferred.
- We may refuse, suspend or limit an account if verification cannot be completed.
5. Account security
You are responsible for keeping your login details, transaction PIN and devices secure, and for all activity under your account. Never share your PIN or verification codes with anyone, including anyone who claims to be from BitFlux. If you suspect unauthorised access to your account, tell us immediately at info@bitflux.link.
6. Transactions
- Blockchain transactions cannot be reversed once submitted. You are responsible for entering the correct address and choosing the correct network (such as ERC20, BEP20, TRC20 or Polygon). Assets sent to a wrong address or over an unsupported network may be lost permanently.
- The rate and any fees for a swap are shown before you confirm it. By confirming, you accept them.
- Fiat withdrawals rely on banks and payment networks, so processing times may vary.
- We may delay, refuse or cancel a transaction if we reasonably believe this is required by law or our risk or compliance policies, or is needed to protect you or others.
7. Fees
Our fees are shown in the app before you confirm a transaction. Blockchain network (gas) fees and fees charged by banks or other third parties may also apply. Where required, we will give you notice before changing our fees.
8. Risks
You understand and accept that:
- the prices of crypto assets can be highly volatile, and you may lose some or all of the value of your assets;
- stablecoins may lose their peg, and their issuers may fail or face regulatory action;
- laws and regulations on crypto assets are changing and may restrict or affect the Services; and
- blockchain networks may suffer delays, congestion, forks or attacks outside our control.
We do not give investment, financial, legal or tax advice. You are solely responsible for your decisions and for any taxes that apply to you.
9. Prohibited use
You must not use the Services to:
- break any law, including anti-money laundering, counter-terrorist financing, sanctions and tax laws;
- commit fraud, run scams or engage in any deceptive activity, or receive the proceeds of crime;
- use another person’s identity or account, or let anyone else use yours;
- abuse the referral program, for example through fake or multiple accounts; or
- interfere with, attack or reverse-engineer the Services, or access them by automated means without our permission.
10. Referral program
Referral rewards are subject to the program rules shown in the app. We may change or end the program, and we may withhold or cancel rewards obtained through abuse or a breach of these Terms.
11. Suspension and closure
We may suspend, restrict or close your account, or freeze assets, where required by law or a competent authority, where we reasonably suspect a breach of these Terms, fraud or other illegal activity, or where needed to protect you, us or others. Where the law allows, we will tell you and give our reasons. You may close your account at any time by contacting us. When your account is closed, you may withdraw your remaining balance, subject to applicable law and to completing any pending checks or obligations.
12. Third-party services
Card issuers, card networks, banks, payment providers, custodians and blockchain networks are independent third parties. Except where the law says otherwise, we are not responsible for their acts or omissions.
13. Intellectual property
The Services, including the BITFLUX name, logo, design and content, belong to us or our licensors. You may use the Services only for your own personal, non-commercial use under these Terms.
14. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee that the Services will be uninterrupted, timely or error-free.
15. Limitation of liability
To the extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or goodwill;
- we are not liable for losses caused by market movements, third-party services, blockchain networks or events beyond our reasonable control; and
- our total liability to you arising out of or in connection with the Services is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits any liability that cannot be limited by law, including liability for fraud.
16. Indemnity
You agree to compensate us for any loss, liability, claim or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date. If the changes are material, we will notify you through the Services or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory laws of your place of residence provide otherwise.
